1. Introduction

Welcome to 8TeckSolution (“Company”, “we”, “our”, “us”). These Terms and Conditions (“Terms”) govern your access to and use of our website, products, and services, including but not limited to e-commerce development, logo design, web development, digital marketing, and branding services.

By accessing our website or availing any of our services, you (“Client”, “you”, “your”) agree to these Terms. If you do not agree, please do not use our services.

These Terms constitute a binding contract under the Indian Contract Act, 1872, and apply to all clients, including individuals, companies, and organizations operating within India or internationally.

 

2. Company Benefits

As a client of 8TeckSolution, you benefit from:

• Customized digital solutions tailored to your business needs.

• Transparent communication throughout all stages of the project.

• Professional-grade design and development using current industry standards.

• Dedicated post-project support for minor fixes and onboarding.

• Data privacy assurance under the Information Technology Act, 2000, and the Digital Personal Data Protection Act, 2023.

• Intellectual property protection once full payment is completed.

 

3. Scope of Services

 

We provide:

• Website Development (static, dynamic, CMS, custom-coded)

• E-commerce Store Setup (Shopify, WooCommerce, custom)

• Logo & Brand Identity Design

• UI/UX Design

• SEO & Digital Marketing

• Web Hosting, Domain Setup & Management

• Web Maintenance Services

• Technical Consulting

All services are rendered on a project-by-project basis, as defined in written quotes or proposals shared via email, invoice, or agreement.

 

4. Engagement Process

Upon your acceptance of a proposal or quotation:

1. A minimum 50% advance payment is required to initiate work.

2. Project timelines and deliverables are clearly defined.

3. The final remaining 50% must be paid before delivery or launch.

4. Communication shall be via email, call, or collaborative tools as agreed.

 

5. Client Obligations

The Client agrees to:

• Provide timely content, feedback, and required materials.

• Ensure the legality of all content and data shared.

• Review deliverables promptly and communicate revisions within agreed timeframes.

• Make payments as per invoice and contract terms.

• Maintain professional and respectful communication.

Failure to fulfill the above may result in project delays or additional costs.

 

6. Payment Terms

• Payments are non-refundable once work has commenced.

• Delays in payments may result in paused services or additional interest of 2% per 15 days.

• Accepted payment modes: UPI, bank transfer, Razorpay, credit/debit card.

• GST (if applicable) will be included in the invoice.

• The final deliverables will be handed over only after full payment clearance.

 

7. Revisions Policy

• Logo Design: Includes up to 2 rounds of revisions.

• Website Design: Includes 2 rounds of changes after the first preview.

• Any additional revision will be billed at a rate of INR 200 per hour or as quoted.

 

8. Intellectual Property Rights

• Upon final payment, the Client gains ownership rights of the final deliverables.

• 8TeckSolution retains the right to showcase completed work in portfolios, marketing material, or on the website unless an NDA is signed.

• Any third-party content or licenses (e.g., stock images, fonts) will be disclosed and managed as per terms.

 

9. Confidentiality & Data Protection

• Both parties agree to maintain confidentiality on all sensitive and business-related information.

• 8TeckSolution complies with the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011.

• We follow data minimization and secure data handling policies.

 

10. Third-Party Services

• We may integrate third-party plugins, APIs, or platforms (e.g., payment gateways, hosting providers).

• We are not liable for disruptions or security issues caused by these external services.

• The Client is responsible for any recurring third-party charges (e.g., domain, hosting).

 

11. Project Timelines

• Estimated timelines are provided at the beginning of the project.

• Delays due to Client inaction, unavailability, or incomplete input will result in a timeline extension.

• Fast-track delivery (urgent) is possible for an additional fee.

 

12. Cancellations & Refund Policy

• Advance payments are non-refundable once the project has begun.

• In the event of early cancellation by the Client, any work done will be billed proportionally.

• We reserve the right to cancel any project due to abusive behavior, non-payment, or breach of terms, without refund.

 

13. Warranties and Disclaimers

• 8TeckSolution delivers services professionally but does not guarantee specific results such as rankings, revenue, or traffic unless explicitly promised in writing.

• Services are provided “as is” without any express or implied warranties.

• We are not liable for any loss, direct or indirect, due to the use or misuse of our services.

 

14. Limitation of Liability

To the extent permitted by law:

• 8TeckSolution’s total liability is limited to the amount the Client paid for the specific service.

• We are not responsible for indirect, incidental, or consequential damages, including but not limited to data loss, business disruption, or financial loss.

 

15. Website Hosting & Maintenance (If Applicable)

• Hosting services are subject to uptime guarantees and policies of the third-party provider.

• Maintenance services (if subscribed) include updates, minor edits, and performance monitoring.

• We are not responsible for downtime caused by hosting providers or client-side changes.

 

16. Grievance Redressal (As per Indian IT Act)

In accordance with Rule 5(9) of the Information Technology Rules, we appoint the following Grievance Officer:

17. Force Majeure

8TeckSolution shall not be held liable for any failure or delay in services due to reasons beyond our control, including but not limited to: acts of God, war, internet outages, or natural disasters.

 

18. Amendments to These Terms

We reserve the right to update these Terms at any time. Clients will be notified of any material changes. Continued use of our services after such changes constitutes acceptance of the revised Terms.

 

19. Governing Law and Jurisdiction

These Terms are governed by the laws of India, and any dispute arising shall be subject to the jurisdiction of the competent courts in Bangalore, Karnataka.
